These Terms of Service ("Terms") govern your access to and use of the GlobalOneTechnology.com website (the "Site") and the purchase of any products or services from Global One Technology Group, Inc. ("Global One Technology," "we," "us," or "our"). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
1. Eligibility and accounts
The Site is intended for business and commercial customers and for individuals who are at least the age of majority in their jurisdiction. You may browse and purchase either as a guest or by creating an account. If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. We may suspend or terminate accounts that violate these Terms.
2. Products, condition, and availability
We sell genuine HPE Enterprise server parts and related products. Products are sold as new or refurbished, as indicated on the applicable product page. Refurbished products are pre-owned units that have been inspected, tested, and restored to working condition, and they may show minor cosmetic wear. Products are inspected and tested prior to shipment.
We strive to describe products, specifications, and compatibility as accurately as possible, but we do not warrant that product descriptions, images, pricing, or other content on the Site are complete, current, or error-free. Product availability is not guaranteed and may change without notice. We reserve the right to limit quantities, discontinue products, or correct errors at any time.
3. Pricing, orders, and payment
All prices are listed in U.S. dollars (USD) by default. Our Site may provide a currency selector that displays approximate prices in other currencies for your convenience; unless otherwise indicated at checkout, orders are processed in U.S. dollars. Prices are subject to change without notice.
We make reasonable efforts to ensure pricing accuracy; however, in the event of a pricing error, we reserve the right to cancel or refuse any order placed for a product listed at an incorrect price, even after the order has been submitted or confirmed. Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraud.
Payment is processed through BigCommerce using Braintree as our payment processor. By submitting an order, you authorize us and our payment processor to charge your payment method for the total amount of your order, including applicable taxes and shipping.
4. Sales tax
We collect sales tax where required by applicable law, based on your shipping destination and our tax obligations. Applicable taxes are calculated and displayed at checkout.
5. Shipping and delivery
We will make reasonable efforts to ship products within the timeframes described on the Site and at checkout. Shipping dates and delivery estimates are not guaranteed, and we are not liable for delays outside our reasonable control. Title and risk of loss for products pass to you upon our delivery of the products to the carrier.
6. Returns, exchanges, and warranties
Returns. All returns require a Return Merchandise Authorization (RMA). Please contact us to request an RMA before returning any product; returns are reviewed and approved on a case-by-case basis. Approved returns are subject to a 25% restocking fee, and return shipping costs are the responsibility of the buyer. Products must be returned in their original condition and packaging. If you receive a defective or incorrect item, please contact us and we will work with you to resolve it.
Product warranties. The warranty period varies by product, ranging from 30 days to 5 years, and is stated on the applicable product page or listing. Where a manufacturer's warranty applies, it is provided subject to the manufacturer's terms. Except for the express limited warranty stated for a given product, and to the fullest extent permitted by law, products are sold "as is" as described in the "Disclaimer of warranties" section below.
7. Acceptable use
You agree not to use the Site to: violate any law or regulation; infringe the rights of others; transmit malware or harmful code; attempt to gain unauthorized access to the Site or its systems; scrape, harvest, or collect data from the Site without our permission; interfere with the proper operation of the Site; or use the Site for any fraudulent or unlawful purpose. We reserve the right to restrict or terminate access for any User who violates these Terms.
8. Intellectual property
All content on the Site — including text, graphics, logos, images, and software — is the property of Global One Technology Group, Inc. or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.
Global One Technology is an independent reseller. HPE, ProLiant, and other product names, trademarks, and registered trademarks referenced on the Site are the property of their respective owners and are used for identification purposes only. Their use does not imply any affiliation with, or endorsement by, the trademark holders.
9. Third-party links
The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is at your own risk and subject to their terms.
10. Disclaimer of warranties
Except for any express limited warranty expressly stated for a product, and to the fullest extent permitted by applicable law, the Site and all products and services are provided on an "as is" and "as available" basis. We disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and you may have additional rights under the laws of your jurisdiction.
11. Limitation of liability
To the fullest extent permitted by law, Global One Technology Group, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business, arising out of or related to your use of the Site or any products or services, whether based in contract, tort, or any other legal theory. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms, the Site, or any product or service will not exceed the amount you paid for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Global One Technology Group, Inc. and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Nebraska, and you consent to personal jurisdiction and venue in those courts. Nothing in this section deprives you of any mandatory legal protections available to you under the laws of your country of residence.
14. Changes to these Terms
We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
